| Objective | This course provides a comprehensive introduction to the contemporary mechanisms of international dispute settlement. It covers both judicial mechanisms (International Court of Justice, Permanent Court of International Justice, inter-State arbitration, investment arbitration) and international commercial arbitration between private parties. Students will gain a solid understanding of the legal foundations, procedures, key institutions, and political and practical considerations involved in the resolution of international disputes. |

| Course Learning Outcomes |
By the end of the course, students will be able to: - Explain the various mechanisms of international dispute settlement and their legal basis. - Understand the jurisdiction, structure, and functioning of the ICJ and the PCIJ. - Describe the functioning of inter-State arbitration: constitution of the tribunal, jurisdiction, applicable law, and award. - Analyse disputes submitted to international commercial arbitration (ICC, LCIA, SIAC, VIAC, UNCITRAL, etc.). - Understand and evaluate the specific characteristics of investment arbitration (ICSID and non-ICSID). - Identify and distinguish issues of jurisdiction, admissibility, applicable law, and enforcement. - Assess the political, economic, and diplomatic dimensions of international dispute resolution. - Resolve a problem question using concepts studied in the course. |
