Objective | The goal of this course of Human Rights Law is to familiarize the stufents in their 2nd year with the European Convention on Human Rights. This course is designed to be an -non-exhaustive- introduction to the substantial law of the Convention. After a general presentation of the Convention and its Protocols (week 1), the question of the nature of the rights enshrined in the Convention and its Protocols, their holders and their classification (week 2) will be examined. Following these introductory weeks, the right to life (week 3), prohibition of torture (week 4), positive obligations of the State under the right to life and prohibition of torture (week 5), right to liberty and security (week 6), right to a fair trial (week 7), the principle of nullum crimen, nulla poena sine lege (week ), the right to respect for private and family life (week 10), freedom of thought, conscience and religion (week 11), freedom of expression (week 12) and freedom of assembly and association (week 13) will be successively treated. Finally, the last class of the semester will be dedicated to the limitation of rights enumerated between articles 8 and 11. |
