À l’issue de ce cours, l’étudiant sera capable de :
1. Expliquer chronologiquement les étapes historiques de l’intégration européenne, les traités fondateurs et les conditions politiques et économiques qui les ont préparés.
2. Distinguer des structures souvent confondues telles que le Conseil de l’Europe, le Conseil européen et le Conseil de l’Union européenne, et déterminer la nature juridique de chacune.
3. Expliquer la composition et les compétences des institutions de l’Union européenne ainsi que les relations d’équilibre institutionnel entre elles.
4. Schématiser étape par étape les procédures décisionnelles de l’Union, notamment la procédure législative ordinaire.
5. Distinguer les compétences exclusives, partagées, d’appui/complémentaires et implicites à partir de domaines politiques concrets, et appliquer les principes de subsidiarité et de proportionnalité à un cas.
6. Classer les sources primaires, dérivées et atypiques du droit de l’Union et exposer, dans le cadre de l’article 288 TFUE, les différences juridiques entre règlements, directives et décisions.
7. Expliquer et appliquer à un litige les principes d’applicabilité directe et de primauté à partir de la jurisprudence fondatrice (Van Gend en Loos, Costa/ENEL, Simmenthal).
8. Discuter l’évolution historique de la protection des droits et libertés fondamentaux au niveau de l’Union, la question de la force obligatoire de la Charte des droits fondamentaux et le processus d’adhésion de l’UE à la CEDH (y compris l’avis 2/13).
9. Lire un arrêt de la Cour de justice de l’Union européenne et en résumer les faits, la question juridique, le raisonnement et la conclusion.
